You agree to cooperate with GASH POINT Co., Ltd. and GASH Point (Hong Kong) Co., Ltd. (“we”, “Company” ) rules for managing intellectual property infringement as described below:

1. When any right owner finds any suspicious infringement to their intellectual property rights caused by any content that any member publish on or in Member Services and its Software/Website, the right owner may provide initial evidence that Company is enough to identify the intellectual property right and provide contact information of the right owner and report the misconduct to our 24-hour Customer Service.

2. Upon the receipt of such report, if we are in doubt of whether they are the right owner, Company may request the complainant to provide: the proof of evidence (such as information of trademark registration) and/or a statement (such as a representation that the allegations are true, the complainant is the copyright owner or the agent of the copyright owner, and that the complainant will be liable for any damage incurred by Media or other person due to false statement).

3. We will handle the complainant based on information provided from the right owner and may provide the name and email of the complainant (the right owner) to the alleged infringer (such as a live streamer) and take reasonable steps to remove the content from Member Services as soon as possible.

4. We will manage the personal data of the alleged infringer (such as a live streamer) according to our Privacy Policy. The complainant shall file a complaint/petition with the police/prosecutorial/judicial/tax authority, or other competent authorities if they wish to obtain the personal data of the alleged infringer. Company will cooperate with the provision of personal data upon the receipt of the demand of the competent authority following the legal procedures.

5. The content published on or in Member Services and its Software/Website by a member cannot be recovered once it is removed by Company based on this infringement claim by a complainant.

6. If the alleged infringer has been reported for an incident of Intellectual Property infringement, Company has rights to terminate to provide all or part of the Member Services to that alleged infringer or member.

7. Company is entitled to announce the results of the disposition, and may decide whether to reactivate all or part of the Member Services based on actual conditions. We will retain and send the records of any suspected infringement, crime, or other conduct breaking the laws and regulations, to the competent authority and its designated agency for safeguarding website content as required by the law, and will cooperate with the investigation by the competent authority.
